Special Education Sample Policies
Special Education - IDEA
Below are OSBA’s sample policies to help you implement the latest requirements of the federal Individuals With Disabilities Act (IDEA). Your board policies must be updated by April 15, 2008. By that date, districts must submit to ODE an assurance that updated policies and administrative regulations for special education programs have been adopted. The IDEA re-authorization emerged from a lengthy process. A re-cap of important dates:

On December 3, 2004, the amended IDEA act was signed in to law by President Bush. In January 2005 the Oregon Legislature received recommended statutory changes to comply with the federal amendments already in place. OSBA updated its Policies and Administrative Regulations in September of 2005 to more closely align with IDEA 2004.

On Aug. 14, 2006 the US Department of Education released final IDEA 2004 regulations, effective Oct. 13, 2006. Following the required period for public notice and comment, in April 2007 the State Board of Education adopted OARs to implement the new regulations. The Oregon Department of Education released its Policies and Procedures in October 2007.

Since then, OSBA policy and legal staff have worked with ODE to create revised policies to help you meet current IDEA requirements. As with all new policy documents, please review the language carefully with respect to application implications within all district programs. Current district policies should be updated to reflect new language. Any major changes beyond what these new sample policies include require ODE review and approval.

Note: CBA, IGAEB and JFCG/GBK/KGC have been removed from this posting. These policies did have language changes but are not required as a part of the IDEA updates.
