HB 2062 implementation materials

The 2009 Oregon Legislative Assembly passed  comprehensive legislation to address sexual grooming behavior (or “sexual conduct” ) by school employees towards students.  As of July 1, 2010, all school districts, ESDs and charter schools must comply with this law.  OSBA has worked closely with the Oregon School Personnel Association (OSPA) and EdZapp to develop materials to support members with HB 2062 compliance.

Educational providers must:

  • Adopt a policy (29K This file is in Microsoft Word format. Click here to download.) related to inappropriate “sexual conduct.” 
  • Post in each school building the contact person designated for the school building to receive reports of suspected child abuse or sexual conduct.
  • Notify all employees of the employer's definition of “sexual conduct.”  We have attached a sample description of sexual conduct, (55K This file is in Adobe Acrobat PDF format. Click here to download.) which may be revised to fit the community norms or special needs of your student population.  Also, attached is a brochure (760K pub) which may be used to communicate your entity’s description of sexual conduct.
  • OSBA has drafted an optional witness disclosure form (18K This file is in Microsoft Word format. Click here to download.) as a tool for the reporting of sexual conduct complaints.
  • Notify all employees that records may be disclosed to future employers if there is a substantiated report of child abuse or sexual conduct.
  • Perform an extensive background check on all new applicants, including sending the attached disclosure release form (35K This file is in Microsoft Word format. Click here to download.) (updated) to the past 3 educational employers of the applicant.
  • Complete all disclosure release forms received from other school districts within 20 days.
  • Ask all applicants particular questions related to whether they are part of an on-going investigation related to sexual conduct or if there have been any substantiated reports of sexual conduct against them.  EdZapp has worked these questions into their online application system.
  • Not enter into any agreements in which the education provider agrees to suppress any information related to a report of sexual conduct or child abuse.
  • Train all employees and students on the prevention of child abuse and sexual conduct and offer this training to parents.
