Our board is hiring a new superintendent. May we discuss the terms of the proposed contract, including salary, in executive session when we discuss our candidate selection?

The board may not discuss salary or contract terms in executive session. Those must be set in public session. This is based on the Attorney General’s Manual page 139.

“ORS 192.660(2)(a) does not apply to consideration of general employment policies, but relates only to the initial hiring of specific individuals. We have concluded that this provision does not allow discussion of an officer’s salary to be conducted in executive session in connection with the hiring of that officer. “
