Renegotiating charter school contracts with sponsor districts
Is there a specific way a charter school board must request re-negotiation of the charter school contract with the sponsoring district? Can it be by a verbal request of one of the charter board members at the sponsoring district meeting?
ORS 338.065(5)(b) states: “The public charter school governing body shall submit a written renewal request to the sponsor for consideration at least 180 days prior to the expiration of the charter.” That means, for instance, if the charter contract expires on June 30, the request must be made in writing to the sponsor by January 1. Receipt of this written request starts the clock on the renewal process outlined in ORS 338.065.
Check your charter contract to see if there are any additional renewal criteria you are required to meet, or a more specified renewal process you are required to follow. For instance, some districts may require that you submit a renewal application as notice of your intent to renew; other district may require that the letter of intent to renew contain any major changes you may ask for in the renewal contract. It is a good idea to connect with your sponsor early about this process, as it varies between districts. Collaborating with your sponsor early can also pave the way for a smoother renewal process.
